1.Acceptance of Terms
By accessing, registering for, or using the AuctionSupreme platform (“Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”) and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform.
2.Eligibility
To participate in auctions you must:
- Be at least 18 years of age
- Be a resident of Canada
- Have a valid Canadian credit or debit card
- Provide accurate, current, and complete registration information
- Verify your email address and add a verified payment card before bidding — see Section 3
By registering, you represent and warrant that you meet all eligibility requirements. AuctionSupreme reserves the right to verify eligibility and suspend accounts that do not comply.
3.Registration & Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to:
- Create only one account per person
- Not share your login credentials with any third party
- Notify us immediately at info@auctionsupreme.com if you suspect unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
AuctionSupreme will never ask for your password via email or phone.
Verification requirement: both bidder and reseller accounts must verify their email address (via the link sent at registration) and add a verified payment card before full account privileges — placing bids, or running a catalogue — are granted.
Reseller accounts: to sell on the Platform, an account must additionally provide a company name (required), and may optionally provide a tax code, company address, and wire transfer details (for receiving auction payouts by wire transfer instead of cheque). Reseller access activates automatically once both the email address and payment card are verified — no separate manual approval step is required.
4.Bidding & Purchases
All bids are legally binding. Once placed, a bid cannot be retracted or cancelled under any circumstances. By placing a bid you are entering into a binding contract to purchase the item at your bid price (plus applicable fees) if you are the highest bidder at auction close.
The highest bidder when the auction closes is obligated to complete the purchase. Failure to pay may result in account suspension and recovery of costs incurred by AuctionSupreme.
AuctionSupreme reserves the right to reject bids from users with outstanding balances or a history of non-payment.
5.Buyer's Premium & Fees
All winning bids are subject to the following fees:
- Buyer's Premium: 15% of the hammer (winning bid) price
- HST: 13% applied to the sum of the hammer price and buyer's premium
Example: A winning bid of $100 results in a buyer's premium of $15 and HST of $14.95, for a total of $129.95.
All prices are in Canadian dollars (CAD). The total due is clearly shown in the bid breakdown before you place a bid.
6.Payment & Invoicing
A valid credit card must be added to your account before placing any bid. Your card is not charged until you win an auction.
Payment is processed automatically via your card on file within 24 hours of auction close. You will receive an email confirmation and a detailed invoice through your dashboard.
If payment fails, AuctionSupreme will notify you and provide a window to update your card and retry. Persistent payment failures may result in cancellation of the sale, forfeiture of the item, and account suspension.
AuctionSupreme uses Helcim, a PCI-DSS compliant payment processor. Your full card number is never stored on our servers.
7.Proxy Bidding
AuctionSupreme offers proxy (automatic) bidding. You may enter the maximum amount you are willing to pay and the system will automatically bid on your behalf in the minimum increment necessary to keep you as the leading bidder — up to your maximum.
Your maximum proxy bid is kept confidential. The system will only bid as high as needed to outbid other bidders. If two proxy bids are equal, the first bid placed takes precedence.
Setting a proxy bid does not guarantee you will win at your maximum; it simply automates the bidding process up to your stated limit.
8.Soft-Close (Anti-Sniping Extension)
To ensure a fair bidding process and prevent last-second “sniping,” AuctionSupreme uses a soft-close system:
- Any bid placed within the final 5 minutes of an auction will automatically extend the auction closing time by 2 minutes
- Extensions continue indefinitely until no bid is received within the 5-minute window
- The extended closing time is displayed in real time on the auction page
This extension policy applies to all auctions on the Platform and cannot be waived.
9.Item Descriptions & Condition
Treasure Antique & Appraisers makes every effort to accurately describe and photograph each item. However:
- All items are sold as-is with no warranty of any kind, express or implied
- Condition descriptions are provided in good faith but are subjective
- AI-assisted descriptions are used as supplementary information only and are reviewed by our staff
- Photographs are taken under controlled lighting and may not perfectly represent colour or texture
We strongly recommend reviewing all photographs and descriptions carefully before bidding. Questions about any item may be submitted to info@auctionsupreme.com prior to placing a bid.
10.Pickup, Delivery & Shipping
Winners are responsible for collecting their items from the address provided for pickup in the invoice, within the allotted pickup time window. Our team will contact winning bidders within 2 business days of auction close to arrange pickup.
If you require shipping, this can be arranged at your expense. AuctionSupreme is not responsible for items once they leave our premises and recommends purchasing shipping insurance for valuable items.
Items not collected during the allotted pickup time are deemed forfeited, and no refund will be issued — you remain charged the full winning bid, buyer's premium, and applicable taxes regardless of pickup. AuctionSupreme additionally reserves the right to charge a disposal fee, at its discretion, to recover the cost of storing or disposing of items that are not collected.
10A.Reseller & Catalogue Integrity
Resellers are responsible for the accuracy and authenticity of every item and lot listed in their catalogues. If a reseller's catalogue is found to be fraudulent — for example, containing fake items or lots that were never genuinely available for sale — AuctionSupreme will:
- Fully refund every affected bidder for amounts already charged on that catalogue
- Hold the reseller liable for the full commission that would have been owed to AuctionSupreme on those sales, regardless of the refunds issued to bidders
- Remove the catalogue from the Platform
This is in addition to, not instead of, any other remedy available to AuctionSupreme, including account termination and legal action.
10B.Prohibited Items
The following items may not be listed, consigned, or sold on the Platform under any circumstances:
- Alcohol
- Guns and firearms
- Sexually graphic images
- Chemicals and toxins
- Gas cylinders
- Drugs and drug paraphernalia
- Tobacco
- Vape products
- Adult toys
- Fireworks
AuctionSupreme reviews every reseller catalogue before it goes live. Any lot found to contain a prohibited item will be flagged and the catalogue rejected; the reseller must remove the flagged lot(s) and resubmit before the catalogue can be approved. Listing a prohibited item may also result in account termination under Section 14.
11.Returns & Refunds
All sales are final. AuctionSupreme does not accept returns or offer refunds, except as set out in Section 10A (Reseller & Catalogue Integrity) in the case of a confirmed fraudulent reseller catalogue.
12.Reserve Prices & Withdrawals
Some items may carry a confidential reserve price — a minimum amount below which the item will not be sold. If the reserve price is not met by auction close, the item will not be sold and no charges will be applied.
AuctionSupreme reserves the right to withdraw any item from auction at any time prior to close, for any reason, without liability to bidders.
13.Prohibited Conduct
You agree not to:
- Place bids with no intention to pay (shill or fictitious bidding)
- Create multiple accounts to manipulate bidding
- Collude with other bidders to suppress prices
- Use automated tools, bots, or scripts to place bids
- Attempt to access, tamper with, or disrupt the Platform or its servers
- Impersonate any person or entity
- Harvest or collect user data from the Platform
Violations may result in immediate account termination, legal action, and recovery of damages.
14.Account Suspension & Termination
AuctionSupreme reserves the right to suspend or permanently terminate any account at its sole discretion, including but not limited to cases of:
- Non-payment of winning bids
- Violation of these Terms
- Fraudulent or abusive behaviour
- Providing false registration information
Terminated users are prohibited from re-registering without express written permission. Outstanding balances remain payable following termination.
15.Privacy & Data
Your personal information is collected and used solely to operate the auction platform, process payments, and communicate with you about your account and purchases.
- We do not sell or share your personal data with third parties except as required to process payments (Helcim) or send email communications (Resend)
- Your first name and last initial may be visible to other users in bid history
- We use cookies and local storage to maintain your session
- You may request deletion of your account and associated data by contacting us
Our practices comply with applicable Canadian privacy legislation (PIPEDA).
16.Intellectual Property
All content on the Platform — including photographs, descriptions, logos, and software — is the property of Treasure Antique & Appraisers or its licensors and is protected by Canadian copyright law. You may not reproduce, distribute, or create derivative works without express written permission.
17.Limitation of Liability
To the maximum extent permitted by applicable law, AuctionSupreme and Treasure Antique & Appraisers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or participation in any auction.
Our total liability in connection with any dispute shall not exceed the total amount you paid for the item in question.
The Platform is provided “as is” without warranty of availability, accuracy, or fitness for a particular purpose.
18.Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Platform shall first be submitted to good-faith mediation. If unresolved within 30 days, disputes shall be resolved by binding arbitration in Halton Region, Ontario, under the Arbitration Act, 1991 (Ontario).
Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction.
19.Changes to Terms
AuctionSupreme reserves the right to update these Terms at any time. Material changes will be communicated by email or a prominent notice on the Platform. Your continued use of the Platform after the effective date of any update constitutes acceptance of the revised Terms.
We recommend reviewing these Terms periodically. The “Last updated” date at the top of this page indicates when the Terms were last revised.
